Saggy Pants Need to Come Up

"There's no excuse for it."  City Council member Joe Sweet stated regarding saggy pants.  "I don't know how we're going to pull them up, but they need to come up."

The City Council appeared to be in total agreement with his statement along with the 3 citizens who took time to attend the meeting and speak.

Concerned that it would include hip-hugger jeans with halters, City Manager Chris Hobby pointed out the "skin" portion of the proposed ordinance is not needed.  He stated state law addresses exposure of skin, but not undergarments.  Mr Hobby will make that change and bring it back to Council for public hearings and enactment.

Council member Luther Conyers asked if it could be enforced on private property.  Public Safety Director Larry Funderburke stated "You can enforce it anywhere if he is exposing it."  Mr Conyers asked "You going to put a full time officer at the schools?"

Chief Funderburke responded "I'm not going to put someone on the street corner waiting for everybody to walk by."  The Chief continued "You can go into a restaurant where you want to sit down and eat and you could ask them to either pull up their pants or go."

City Manager stated the penalties for violation would be set by the Municipal Judge.  Municipal code sets the maximum at $1000.

An Ordinance To Amend Chapter 54 Of The Code Of Ordinances Of The City Of Bainbridge, Georgia Adding Therto A New Section Numbered 54-16 And Entitled "Indecent Exposure"

The City Council of the City of Bainbridge hereby ordains that the Code of Ordinances of the City of Bainbridge, Georgia is hereby amended by adding a section to be numbered 54-16, that reads as follows:

Section 54-16. Indecent Exposure
It shall be unlawful for any person to appear in any public place, on the sidewalks, public parking lots, streets or alleys of the city wearing pants or shorts below the waist, which expose the skin or undergarments.
